1. Project Materials

It is the responsibility of the client to provide all necessary materials, information, content, images, logos, and other assets required for the project. Any delay in providing the required materials may affect the agreed project timeline and the delivery of the final product.

2. Project Timeline

Project timelines and delivery dates will be agreed upon and confirmed upon receipt of full payment and the required project materials. Delays caused by the client, including delays in providing materials, feedback, approvals, or information, may result in an adjustment to the project timeline.

3. Portfolio & Marketing Rights

Nivmas Enterprise reserves the right to display, reference, or use completed work created for the client in its portfolio, website, social media, promotional materials, and other advertising or marketing materials for the purpose of showcasing its services.

4. Urgent / Expedited Delivery

Requests for urgent or expedited delivery will be subject to an additional expedition fee of 30% of the total project fee. Acceptance of urgent projects is subject to Nivmas Enterprise’s availability and approval.

5. Amendments & Additional Work

The project includes the agreed scope of work. Any amendments, revisions, additions, or requests made after the project has been finalised or outside the agreed scope may be subject to additional charges. Any additional charges will be communicated to the client before the additional work is undertaken.

6. Changes to Terms & Conditions

Nivmas Enterprise reserves the right to modify, amend, or update these Terms & Conditions from time to time. Any changes will apply to future projects, renewals, or services unless otherwise agreed in writing.

Payment Terms

Full payment is required upon confirmation of the project and before any work commences.

The project will only be scheduled and work will begin once full payment has been received by Nivmas Enterprise. Project timelines and delivery dates will be confirmed thereafter, subject to the timely provision of all required materials, information, feedback, and approvals by the client.

Yearly Subscription, Maintenance & Renewal

Where the service is provided under a yearly subscription, the subscription will remain active for the agreed annual subscription period and will be subject to renewal in accordance with the applicable subscription terms.

Cancellation of Yearly Subscription

To cancel a yearly subscription and prevent its renewal, the client must submit a written cancellation request to Nivmas Enterprise at least six (6) months before the subscription renewal date.

The cancellation request must clearly state that the client does not wish to renew the yearly subscription.

If written notice is not received at least six (6) months before the renewal date, the subscription may be renewed for the subsequent subscription period in accordance with the applicable subscription terms.

Maintenance & Updates During Cancellation Period

Once a cancellation request has been received and accepted, website maintenance, content updates, technical updates, and other update-related services will be discontinued six (6) months before the subscription renewal date.

The client acknowledges that no maintenance or updates will be provided during this six-month period prior to the renewal date following the cancellation of the yearly subscription.

Limitation of Liability

Nivmas Enterprise shall not be liable to the client for any pure economic loss, loss of profit, loss of business, loss of revenue, depletion of goodwill, or any direct, indirect, incidental, special, or consequential loss arising out of or in connection with the services or the Contract.

Nivmas Enterprise shall also not be liable for any consequential compensation or damages, however caused, arising from or in connection with the services provided.

Cancellation & Refund Policy

All payments made to Nivmas Enterprise are strictly non-refundable, unless otherwise agreed in writing by Nivmas Enterprise.

Cancellation of a project may only be requested within three (3) working days from the date of payment. Any cancellation request submitted within this period will be subject to review and approval at the sole discretion of Nivmas Enterprise.

After the three (3) working-day period, cancellation requests will generally not be accepted, and payments made will remain non-refundable.

By confirming the project or subscription, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
